Welcome to Sleepwell Bedding. The terms “we,” “us,” and “our” refer to Sleepwell Bedding.

Sleepwell Bedding operates this website and store, including the information, content, features, tools, products, and services made available through it. Shopify provides the ecommerce platform that enables us to offer these services.

These Terms of Service, together with the policies referenced below, explain your rights and responsibilities when using our website or purchasing from Sleepwell Bedding.

By visiting our website, creating an account, placing an order, or using our services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use our services.

1. Eligibility and Website Use

By using our services, you confirm that you are at least the age of majority in your province or territory of residence or that you have permission from a parent or legal guardian.

You agree to provide accurate, current, and complete information when creating an account, requesting a quote, or placing an order.

You may use our website and services only for lawful personal or household purposes. Products may not be purchased for unauthorized resale, export, or other commercial purposes without our written permission.

2. Products and Availability

We make reasonable efforts to display and describe our products accurately. However, colours and product appearance may vary slightly depending on your screen, device settings, lighting, and materials.

Product descriptions, specifications, materials, designs, pricing, and availability may be updated without notice. We may discontinue a product or limit the quantity available for purchase.

Many popular standard-size mattresses are regularly kept in stock. Availability can change based on the mattress model, size, and current demand.

Custom and made-to-order mattresses are generally ready within 3–7 business days. Special sizes, unusual shapes, large quantities, material requests, or production demand may require additional time.

If you need a product by a particular date, please call 204-786-2225 before ordering so we can confirm current availability and timing.

3. Orders and Acceptance

Submitting an order represents an offer to purchase from Sleepwell Bedding.

An automatic order acknowledgement or payment authorization does not necessarily mean that the order has been accepted. We reserve the right to accept, decline, or cancel an order when reasonably necessary, including because of:

  • Product unavailability
  • Incorrect pricing or product information
  • Payment authorization problems
  • Suspected fraud or unauthorized activity
  • Delivery limitations
  • Errors in the order
  • Quantity restrictions

If we cannot accept an order after payment has been processed, we will notify you and issue an appropriate refund to the original payment method.

Please review all product selections, mattress sizes, measurements, comfort choices, delivery information, and contact details before submitting an order.

4. Order Cancellations

Standard-size, non-custom orders may be cancelled before pickup or delivery.

To request cancellation, call 204-786-2225 or email info@sleepwellbedding.ca as soon as possible. A cancellation is not complete until it has been confirmed by Sleepwell Bedding.

Custom and made-to-order products are final sale once the order is placed. They cannot be cancelled, returned, or refunded except when defective, damaged, incorrect, or otherwise required by applicable law.

5. Custom and Made-to-Order Products

Customers are responsible for confirming all measurements, dimensions, shapes, materials, and comfort selections before placing a custom order.

We will manufacture the product using the specifications confirmed with the customer. Sleepwell Bedding is not responsible for measurement or specification errors provided or approved by the customer.

If you are unsure how to measure or choose specifications, please contact us before ordering.

Custom and made-to-order products are final sale once ordered, subject to applicable consumer rights relating to defective, damaged, or incorrect products.

6. Prices, Taxes, and Promotions

Unless otherwise stated, all prices are displayed in Canadian dollars.

Product prices, promotions, discounts, delivery fees, and other charges may change without notice. The price applicable to your purchase will normally be the price displayed when the order is placed.

Applicable taxes, delivery charges, old-item pickup fees, assembly charges, and other requested services will be shown at checkout or confirmed before the order is completed.

Online prices and promotions may occasionally differ from those available in our showroom, by telephone, or through another sales channel.

Promotional offers may have separate eligibility requirements, dates, exclusions, and conditions. If promotional terms conflict with these Terms of Service, the specific promotional terms will apply to that promotion.

7. Payments and Financing

You agree to provide accurate and complete billing and payment information. You confirm that you are authorized to use the payment method provided.

Payment may be required in full before an order is manufactured, released for pickup, or scheduled for delivery.

Financing and installment-payment options, when available, are provided by third-party financial or payment providers. Approval, payment schedules, interest, fees, and other financing conditions are determined by the applicable provider and are subject to its separate terms.

Sleepwell Bedding does not guarantee approval for any financing or installment-payment service.

8. Pickup, Delivery, and Shipping

Please wait until we confirm that your order is ready before arriving for pickup.

Local in-room delivery is available within eligible Winnipeg and nearby delivery areas for the applicable fee. Delivery outside Winnipeg or shipping to another province may be available by custom quote.

Delivery dates, times, and requested delivery windows are subject to product readiness, scheduling availability, weather, road conditions, building access, and other circumstances.

Any delivery estimate is provided in good faith but is not guaranteed unless Sleepwell Bedding expressly confirms otherwise in writing.

Customers must provide an accurate address and disclose relevant access conditions, including stairs, elevators, narrow entrances, limited parking, or other restrictions. An adult must be available to receive the delivery and provide access to the selected room.

Responsibility for the product passes to the customer when the order is delivered to the provided address or collected from our store, except where applicable law provides otherwise.

9. Returns, Refunds, and Comfort Adjustments

Products cannot be returned or exchanged after pickup or delivery because of a change of mind, an incorrect size ordered by the customer, or a change in comfort preference.

Eligible mattress purchases may qualify for one complimentary comfort adjustment after at least 14 nights of use when requested within 30 days of pickup or delivery.

The comfort adjustment is not a return, exchange, or refund. The mattress must be clean, dry, sanitary, and brought to our Winnipeg shop. Pickup and redelivery may be available for an additional fee.

10. Damaged, Defective, or Incorrect Products

Please inspect your order when it is picked up or delivered.

Contact us immediately if a product is damaged, appears defective, is missing, or is different from what you ordered. Please provide your order number, a description of the problem, and photographs when possible.

We will evaluate the concern and provide an appropriate remedy. Depending on the circumstances, this may include repair, replacement, correction of the order, or a refund.

Nothing in these Terms limits any warranty or consumer right that cannot legally be excluded.

11. Accounts and Account Security

You may be able to create a customer account to access certain features.

You are responsible for:

  • Maintaining the confidentiality of your login information
  • Providing accurate account information
  • Updating your information when it changes
  • Activity occurring through your account

Please notify us promptly if you believe your account has been accessed without permission.

We may suspend or restrict an account when reasonably necessary to protect customers, prevent fraud, maintain website security, or address a violation of these Terms.

12. Intellectual Property

The content available through our services—including text, photographs, graphics, videos, logos, trademarks, product information, website design, and other materials—is owned by Sleepwell Bedding or used with permission.

You may use our website for personal, non-commercial purposes only.

Without prior written permission, you may not copy, reproduce, distribute, modify, republish, sell, scrape, or commercially exploit our website content.

Shopify and other third-party names, logos, and trademarks belong to their respective owners.

13. Third-Party Services and Links

Our website may include payment services, financing services, applications, links, or tools operated by third parties.

Third-party services are governed by their own terms and privacy policies. Sleepwell Bedding does not control these services and is not responsible for their separate websites, decisions, content, availability, or practices.

14. Relationship With Shopify

Shopify provides the ecommerce platform used to operate our online store.

Products purchased through our website are sold by Sleepwell Bedding, not Shopify. Sleepwell Bedding is responsible for order acceptance, products, customer service, pickup, delivery, returns, refunds, and warranty assistance.

16. Reviews and Feedback

To the extent permitted by law, Sleepwell Bedding will not be responsible for indirect, incidental, special, or consequential loss resulting solely from the use or inability to use our website.

Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, personal injury caused by negligence, or any liability or consumer right that cannot legally be excluded.

22. Indemnification

To the extent permitted by law, you agree to be responsible for losses or claims directly resulting from your unlawful use of the services, your infringement of another person’s rights, or your material violation of these Terms.

This section does not make you responsible for losses caused by Sleepwell Bedding or for any responsibility that cannot legally be transferred to a consumer.

If any part of these Terms is found to be unlawful, invalid, or unenforceable, that part will be limited or removed only to the extent necessary. The remaining provisions will continue to apply.

24. Waiver and Entire Agreement

If we do not immediately enforce a provision of these Terms, that does not mean we have waived our right to enforce it later.

These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, Delivery page, Warranty & Return Policy, and any order-specific terms confirmed with you, form the agreement between you and Sleepwell Bedding concerning your use of our services and purchases.

If an order-specific written agreement conflicts with these general Terms, the order-specific agreement will apply to that order, subject to applicable law.

25. Assignment

You may not transfer your rights or obligations under these Terms without our written consent.

Sleepwell Bedding may transfer its rights or obligations as part of a business reorganization, sale, or transfer, provided doing so does not reduce any non-excludable consumer rights.

26. Governing Law

These Terms are governed by the laws of the Province of Manitoba and the federal laws of Canada applicable in Manitoba.

Any dispute will be handled by a court with lawful jurisdiction. Nothing in this section prevents a consumer from relying on mandatory protections available under applicable consumer law.
